Welcome to SKYE ("SKYE", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, mobile application, and services (collectively, the "Platform").
By accessing or using SKYE, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Platform.
SKYE is intended to operate as a Florida-based aviation networking and technology platform. SKYE is not an air carrier, flight school, aircraft operator, charter broker, maintenance provider, insurance provider, aircraft broker, or aviation service provider.
1. ELIGIBILITY
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Platform. By using SKYE, you represent and warrant that you meet these requirements.
You may not use the Platform if you are prohibited from doing so under applicable law, aviation regulation, contractual restriction, employment policy, or regulatory order.
2. DESCRIPTION OF SERVICES
SKYE is an aviation networking platform that enables users to connect with flight instructors (CFIs), student pilots, safety pilots, aircraft owners, aviation professionals, and other aviation-related users.
The Platform may include features related to time building, safety pilot networking, aircraft rental, aircraft buying and selling, aviation services, maintenance providers, brokerage-related connections, aircraft parts, hangars, aviation real estate, sightseeing-related listings, scheduling, communications, digital logbook tools, and other aviation-related listings or services.
The Platform is intended for aviation networking and informational purposes only and may not be used to arrange unauthorized charter flights, air taxi services, paid passenger transportation, or illegal commercial air transportation.
3. TECHNOLOGY PLATFORM ONLY
SKYE is a technology platform only. SKYE does not own, operate, manage, dispatch, maintain, inspect, broker, charter, rent, lease, sell, or control any aircraft, flight school, training organization, maintenance provider, broker, aviation service provider, or user listed on the Platform.
SKYE does not exercise operational control over any flight and does not act as pilot in command, operator, air carrier, commercial operator, charter broker, aircraft broker, maintenance provider, insurer, escrow agent, payment guarantor, or employer of any user.
All aviation services, flights, instruction, aircraft rentals, aircraft sales, maintenance activities, brokerage activities, payments, listings, and transactions are provided or conducted by independent third parties, not by SKYE.
4. NO AVIATION SERVICES PROVIDED BY SKYE
SKYE does not provide flight training, flight instruction, aircraft operations, aircraft dispatch, aircraft release, maintenance services, brokerage services, insurance, regulatory advice, legal advice, air transportation, charter services, air taxi services, aircraft sales services, or aircraft rental services.
Users are solely responsible for verifying credentials, licenses, ratings, certificates, flight experience, medical certificates, currency, insurance, aircraft documents, aircraft condition, maintenance records, airworthiness, ownership, legal authority, and compliance with all applicable laws and aviation regulations.
5. USER ACCOUNTS
To access certain features, you may be required to create an account. You agree to provide accurate, complete, current, and non-misleading information and to update your information as necessary.
You are responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account.
We reserve the right to suspend, restrict, or terminate accounts that violate these Terms, create legal or safety risk, misuse the Platform, or undermine user trust.
6. USER VERIFICATION DISCLAIMER
SKYE may allow users to display licenses, ratings, certificates, flight experience, aircraft information, insurance information, or other aviation-related credentials.
Unless expressly stated otherwise in writing, SKYE does not independently verify, certify, endorse, or guarantee any user's identity, aviation qualifications, pilot certificates, medical certificates, ratings, currency, flight time, insurance coverage, aircraft ownership, aircraft airworthiness, maintenance status, employment status, background, financial condition, or legal authority to provide any aviation-related service.
Users are solely responsible for conducting their own due diligence before engaging with any other user, aircraft, service provider, instructor, safety pilot, aircraft owner, broker, maintenance provider, or aviation professional.
7. FAA AND REGULATORY COMPLIANCE
All users are solely responsible for complying with all applicable federal, state, local, and international aviation laws, rules, regulations, and guidance, including but not limited to FAA regulations, TSA requirements, DOT rules, airport rules, aircraft operating limitations, insurance requirements, and applicable foreign aviation authority regulations.
SKYE does not provide legal, regulatory, operational, flight safety, tax, insurance, or aviation compliance advice. Any information available on the Platform is provided for general informational and networking purposes only and should not be relied upon as legal, operational, regulatory, or safety guidance.
Users must consult qualified aviation counsel, flight instructors, aircraft operators, insurance providers, maintenance providers, or regulatory authorities where appropriate.
8. TIME BUILDING, SAFETY PILOT, AND COST SHARING
SKYE may allow users to connect for time building, safety pilot opportunities, shared flight expenses, and similar aviation networking purposes.
Any time building, safety pilot, or shared flight expense arrangement made between users must comply with all applicable aviation regulations.
Users are solely responsible for determining whether a proposed flight involves permissible cost sharing, compensation, common purpose, operational control, aircraft rental, instruction, safety pilot duties, pilot certification requirements, medical requirements, currency requirements, insurance requirements, or any other regulated aviation activity.
SKYE does not determine whether any proposed flight is legal, compliant, insured, properly conducted, or permissible under FAA regulations or other applicable aviation laws.
9. NO ILLEGAL CHARTER, AIR TAXI, OR UNAUTHORIZED COMMERCIAL OPERATIONS
SKYE strictly prohibits the use of the Platform for illegal charter operations, unauthorized commercial air transportation, air taxi services, paid passenger transportation, common carriage, or any flight operation requiring certification, authorization, or approval from the FAA or any other applicable aviation authority.
Users may not use SKYE to advertise, arrange, solicit, offer, request, accept, broker, coordinate, or conduct charter flights, air taxi services, paid passenger transportation, common carriage, or commercial aviation operations unless they are properly authorized, certified, licensed, insured, and legally permitted to do so under applicable law.
Users may not use SKYE to "hold out" to the public as providing air transportation for compensation or hire unless they are properly authorized to do so under applicable aviation law.
Any content, listing, message, profile, or activity that appears to involve unauthorized charter activity, illegal compensation, paid passenger carriage, improper commercial aviation activity, or violation of aviation regulations may be removed, restricted, reported, or result in account suspension or termination.
10. INSURANCE DISCLAIMER
SKYE does not provide, verify, endorse, or guarantee aviation insurance, aircraft insurance, renter's insurance, instructor insurance, liability insurance, hull insurance, passenger coverage, product liability coverage, professional liability coverage, or any other insurance coverage.
Users are solely responsible for confirming that appropriate insurance coverage exists before participating in any flight, aircraft rental, aircraft sale, training activity, safety pilot arrangement, maintenance activity, brokerage activity, aircraft parts transaction, hangar transaction, real estate transaction, or aviation-related service.
SKYE shall not be liable for any uninsured or underinsured loss, claim, damage, injury, accident, incident, enforcement action, or dispute.
11. AIRCRAFT LISTINGS, SALES, RENTALS, AND TRANSACTIONS
SKYE may allow users to post or view aircraft listings, aircraft rental opportunities, aircraft sales, aircraft parts, hangars, aviation real estate, or related aviation listings.
SKYE does not inspect, own, operate, maintain, broker, appraise, certify, insure, endorse, or verify any aircraft, aircraft part, hangar, real estate, or aviation-related listing.
Users are solely responsible for verifying title, registration, ownership, liens, airworthiness, maintenance records, logbooks, damage history, inspections, pre-buy inspections, conformity, regulatory compliance, insurance, taxes, escrow, export/import restrictions, and all transaction terms.
SKYE is not a party to any sale, lease, rental, brokerage, maintenance, inspection, escrow, payment, or aviation-related transaction between users.
12. MAINTENANCE AND AVIATION SERVICES DISCLAIMER
SKYE may allow users to connect with mechanics, maintenance providers, brokers, consultants, aircraft owners, pilots, instructors, sightseeing providers, parts sellers, hangar owners, real estate sellers, or other aviation service providers.
SKYE does not provide, supervise, approve, certify, warrant, or guarantee any maintenance, inspection, repair, brokerage, consulting, training, sightseeing, aircraft parts, hangar, real estate, or aviation-related service.
Users are solely responsible for verifying licenses, authorizations, experience, insurance, regulatory approvals, and legal authority of any aviation service provider before engaging in any service or transaction.
13. NO EMERGENCY, DISPATCH, OR OPERATIONAL RELIANCE
SKYE is not intended for emergency communication, flight dispatch, operational control, flight following, air traffic services, weather briefing, flight planning approval, maintenance release, aircraft release, crew scheduling compliance, duty time compliance, or safety-critical decision-making.
Users must not rely on SKYE for real-time operational, emergency, regulatory, dispatch, weather, aircraft status, maintenance status, or flight safety decisions.
Users must use appropriate official sources, qualified personnel, and approved systems for all safety-critical aviation decisions.
14. USER CONDUCT
You agree not to misrepresent your qualifications, certifications, licenses, ratings, medical status, flight time, insurance coverage, aircraft ownership, aircraft availability, employment status, or authority to provide aviation services.
You agree not to violate aviation laws, FAA regulations, TSA requirements, DOT rules, airport rules, insurance requirements, or any applicable law while using the Platform.
You agree not to use the Platform for unlawful, fraudulent, misleading, unsafe, abusive, harassing, discriminatory, defamatory, infringing, spam-related, or harmful purposes.
You agree not to interfere with the Platform, attempt unauthorized access, scrape data without permission, impersonate another person, or misuse user information.
15. PROHIBITED AVIATION CONTENT AND ACTIVITIES
Users may not post, offer, request, arrange, promote, or participate in: illegal charter flights or unauthorized commercial air transportation; paid passenger carriage without proper certification or authority; misleading pilot qualifications, ratings, medical certificates, or flight time; false aircraft ownership, rental availability, maintenance status, or airworthiness claims; unsafe, reckless, or non-compliant aviation activities; services requiring a license, certificate, insurance, or regulatory approval that the user does not possess; fraudulent aircraft sales, rentals, parts, maintenance, brokerage, hangar, real estate, or aviation services; or any activity that violates FAA regulations, TSA requirements, DOT rules, airport rules, or applicable aviation laws.
16. USER CONTENT AND LISTINGS
Users may be permitted to create profiles, upload photos, post listings, send messages, publish availability, describe services, advertise opportunities, or submit other content through the Platform.
You are solely responsible for all content you submit, post, display, transmit, or otherwise make available through SKYE.
You represent and warrant that your content is accurate, lawful, non-misleading, and does not violate any aviation regulation, intellectual property right, privacy right, publicity right, contract, law, or third-party right.
By submitting content to SKYE, you grant SKYE a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to host, store, reproduce, display, publish, distribute, modify, and use such content as reasonably necessary to operate, promote, improve, and provide the Platform.
SKYE may remove, restrict, edit, or disable access to any content at any time if we believe it violates these Terms, applicable law, aviation safety principles, user trust, or the integrity of the Platform.
17. REVIEWS AND RATINGS
SKYE may allow users to submit reviews, ratings, comments, or feedback regarding other users, services, listings, or transactions.
Reviews and ratings reflect the opinions of individual users and do not represent the opinion, verification, or endorsement of SKYE.
Users may not submit false, defamatory, abusive, misleading, retaliatory, paid, manipulated, or fraudulent reviews.
SKYE may remove or restrict reviews that we believe violate these Terms, applicable law, user trust, or the integrity of the Platform.
18. MESSAGING AND COMMUNICATIONS
SKYE may provide messaging, contact, scheduling, calendar, notification, or communication tools for user convenience.
SKYE does not guarantee delivery, accuracy, confidentiality, timing, or availability of communications between users.
Users are solely responsible for confirming all important details outside the Platform where appropriate, including flight details, aircraft availability, legal requirements, payment terms, insurance, scheduling, operational decisions, and regulatory compliance.
19. PAYMENTS, SUBSCRIPTIONS, ADVERTISING, AND REFUNDS
SKYE may offer paid subscriptions, advertising packages, promoted listings, premium profiles, transaction-related features, or other paid features.
Unless otherwise stated, fees are charged in advance and may be recurring. Users are responsible for canceling subscriptions before renewal if they do not wish to continue.
Paid placement, advertising, promoted visibility, or premium status does not constitute endorsement, verification, certification, approval, recommendation, or guarantee by SKYE.
All refund, cancellation, renewal, billing, tax, and payment terms will be disclosed at or before the time of purchase and may be processed through third-party payment providers.
20. THIRD-PARTY PAYMENT PROVIDERS
Payments on or through the Platform may be processed by third-party payment providers, including but not limited to Stripe.
SKYE does not store full payment card information and is not responsible for payment processing errors, chargebacks, failed payments, banking issues, currency conversion, taxes, or disputes handled by third-party payment providers.
Users are responsible for all taxes, fees, and charges associated with their transactions.
21. DISPUTES BETWEEN USERS
SKYE is not a party to any agreement, transaction, flight arrangement, aircraft rental, aircraft sale, training activity, maintenance service, brokerage arrangement, payment, or dispute between users.
Users agree to resolve disputes directly with each other.
SKYE has no obligation to mediate, investigate, resolve, refund, compensate, or become involved in user disputes, although we may choose to assist, restrict accounts, remove content, or cooperate with authorities at our sole discretion.
22. ASSUMPTION OF AVIATION RISK
Aviation activities involve inherent risks, including but not limited to personal injury, death, property damage, regulatory violations, financial loss, operational errors, weather-related risks, aircraft mechanical issues, and third-party misconduct.
By using SKYE to connect with other users or participate in aviation-related activities, you understand and voluntarily assume all risks associated with such activities.
SKYE shall not be responsible for any aviation accident, incident, injury, death, property damage, financial loss, regulatory violation, enforcement action, or dispute arising from user activities.
23. THIRD-PARTY SERVICES AND LINKS
The Platform may contain links to or integrations with third-party websites, app stores, payment processors, aviation service providers, mapping services, calendar services, communication tools, or other third-party services.
SKYE does not control and is not responsible for third-party services, content, policies, availability, accuracy, security, or practices.
Your use of third-party services is governed by the applicable third-party terms and policies.
24. DIGITAL LOGBOOK AND DATA TOOLS DISCLAIMER
SKYE may offer digital logbook, scheduling, document storage, image capture, calendar, reminder, or aviation data tools.
These tools are provided for convenience only. Users are solely responsible for ensuring the accuracy, completeness, legality, backup, and official acceptability of any logbook entry, training record, certificate, endorsement, flight time record, or aviation document.
SKYE does not guarantee that any digital record will satisfy FAA, employer, flight school, insurance, immigration, tax, audit, or other regulatory requirements.
25. DISCLAIMER OF WARRANTIES
The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, statutory, or otherwise.
To the maximum extent permitted by law, SKYE disclaims all warranties, including warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, non-infringement, safety, legality, regulatory compliance, and suitability for aviation use.
SKYE makes no warranties regarding the accuracy of information, the availability of the Platform, the identity or qualifications of users, the safety or legality of services offered by users, the completion of transactions, or the outcome of any user interaction.
26. LIMITATION OF LIABILITY
To the maximum extent permitted by law, SKYE shall not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages, including loss of profits, loss of data, loss of goodwill, business interruption, personal injury, death, property damage, aviation incident, aviation accident, regulatory action, enforcement action, or user dispute arising from or related to your use of the Platform.
SKYE shall not be liable for any interactions, communications, agreements, payments, flights, aircraft rentals, aircraft sales, maintenance services, instruction, safety pilot arrangements, time building arrangements, listings, or transactions between users.
Your use of the Platform is at your own risk.
27. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless SKYE and its owners, officers, directors, employees, contractors, agents, affiliates, successors, and assigns from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to: your use of the Platform; your content or listings; your interactions with other users; your aviation activities; your violation of these Terms; your violation of applicable law or aviation regulations; your misrepresentation; your negligence or misconduct; or any dispute, accident, incident, injury, death, damage, payment issue, or transaction involving you or your activities.
28. TERMINATION
We may suspend, restrict, or terminate your access to the Platform at any time, with or without notice, if we believe you have violated these Terms, created risk for SKYE or other users, engaged in unsafe or unlawful conduct, misused the Platform, or acted in a way that harms the integrity, reputation, legality, or safety of the Platform.
Upon termination, your right to use the Platform will immediately cease. Sections intended to survive termination will continue to apply, including disclaimers, limitation of liability, indemnification, dispute provisions, and governing law provisions.
29. PRIVACY POLICY
Your use of SKYE is also governed by our Privacy Policy, which explains how we collect, use, store, share, and protect personal information.
By using the Platform, you acknowledge that you have reviewed and agree to the practices described in our Privacy Policy.
30. MOBILE APPLICATION TERMS
If you access SKYE through a mobile application downloaded from the Apple App Store, Google Play Store, or another app marketplace, you also agree to comply with the applicable app store terms and policies.
The app store provider is not responsible for the Platform, its content, user activity, aviation services, transactions, support, claims, or disputes between users.
31. GOVERNING LAW; JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.
To the extent permitted by law, any dispute, claim, or legal proceeding arising out of or relating to these Terms, the Platform, or your use of SKYE shall be brought exclusively in the state or federal courts located in Florida. You consent to the jurisdiction and venue of such courts.
32. ARBITRATION; CLASS ACTION WAIVER
To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, or your use of SKYE shall be resolved by binding individual arbitration, rather than in court, except where prohibited by applicable law.
You and SKYE agree that any claims must be brought only in an individual capacity and not as a plaintiff or class member in any class, collective, consolidated, or representative action.
Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction where appropriate.
33. CHANGES TO TERMS
We may update these Terms at any time. If we make material changes, we may provide notice through the Platform, by email, or by other reasonable means.
Your continued use of the Platform after updated Terms become effective constitutes acceptance of the updated Terms.
